FREE Demand Service

No charges on payments made, and reported to us within 10 days. We will automatically proceed with Personal Service upon expiration of the Free Demand Period for any unpaid balance. No account will be accepted for the Free Demand Period only. Promises of payment during the Free Demand Period entitles claimant to No Charge only on that portion actually paid within the Free Demand Period. The Free Demand Period is calculated as 10 days from the date on the Claim Placement Form.

No account over 6 months old will be accepted for Free Demand.

Immediate Services

All placements not requesting Free Demand Service will be put into our system for immediate collection service. Your debtor is notified within 24 hours that we are involved and will be handling this matter until it is resolved.

Commercial Collection Division

Services: Immediate Personal Service:

When your debtor has failed to respond to your previous collection efforts, this service will, at once, provide individualized analysis of each account and implementation of the fastest, most efficient method of collection. You will be advised promptly of the results of our PERSONAL contact with your debtor.

We combine our proven collection letters with phone calls and personal meetings with your debtor to bring about payment.

Rates: Contingent Upon Collection - Immediate Personal Service:

Our rates are competitive based upon industry standards set by the Commercial Law League of America:

  • 25% of the first $2000 per placement
  • 20% of the exceeding $2000 collected

These services are available except where prohibited. Our fee will be charged on accounts withdrawn from active collection, or settled direct. Merchandise accepted by you, our client is considered a direct settlement, in lieu of payment and is subject to our fee. Installment payments involve extra expense and work, regular rates are not always adequate. Where necessary, a reasonable and additional charge is made on such payments.

Attorney Forwarding Service:

In the event it becomes necessary to forward your claim to an attorney, as your agent and as a convenience to you, we will send the account to a lawyer designated by you in the debtor's county, or, where none is so designated, to an attorney whose name or firm appears in a recognized Law List, upon prevailing rates in the area. Authorization from you is required to file suit or to compromise any account. If legal proceedings are authorized, there may be advanced funds required from you by counsel to begin suit. These may include court costs, suit fees, and sometimes a retainer. Contingent fee for commercial accounts collected with the intervention of an attorney will be 35%.

Retail Division

  • by providing you with the fastest, most efficient most productive world-wide collection service available.
  • by upholding the integrity, dignity and honor of the Credit Profession in dealing with debtors.
  • by doing whatever is required to protect the interest of our clients.
  • by using any and all remedies afforded by the FDCPA.

Minimum Retail Rates

35% of all funds collected.

If funds are collected by counsel the contingent fee becomes 50%.

On accounts paid direct, merchandise returned or on accounts withdrawn pending collection, full fee will be charged.

Litigated or tracing cases are not recognized as being in the same category as an ordinary collection case and charges will be commensurate with services rendered.

We have a complete Skip Tracing Division which is used effectively, in special cases, to locate debtors throughout the country. Fees for this service may be charged apart from ordinary collection fees. Additional information concerning this service is available upon request. Attorney Forwarding Service:

Our Procedure:

Placing an Account for Collection

Our policy dictates that notification be sent to the debtor stating that the account has been placed for collection within one business day of placement. We find it far more efficient to send that initial notice with an itemized statement of account in DUPLICATE enclosed. It is requested that the account be supported with the original or duplicate copies of the following when applicable:

PROMISSORY NOTE * CONTRACT * INVOICE * ASSIGNMENT * RETURNED CHECKS * CREDIT APPLICATION * TRADE REFERENCES * PERSONAL GUARANTEE

If known - it is also important to submit the names and titles of the:
Debtor's Current Employer or;
Debtor's last known employer

After an Account has Been Placed for Collection

Payments made direct to our clients are subject to full fees:

IMPORTANT: We MUST be advised of direct payment immediately by letter or telephone. It is important to let us know as soon as possible that a payment has been made to avoid the potential of violating State and/or Federal Law. (i.e. FDCPA)
Reporting the following will help in the quest for your money:
Debtor's name, trade style, city and state
Amount received
Name of Bank - branch - city and state
Date payment received and date of check
If possible provide us with a copy of the check

Communication received by our clients:

If you receive any calls or correspondence from the debtor, the caller or the correspondence should be forwarded to DELTA along with the answers to any questions contained therein. It is important that all contact with the debtor be made through our office after the account is placed for collection.

IF YOU STAY IN TOUCH WITH YOUR DEBTOR, IT WILL DIMINISH OUR EFFECTIVENESS AND SLOW DOWN THE COLLECTION CYCLE

Telephone or personal contact received by our clients:
It is important that the debtor be referred to us at all times.
The debtor is now experiencing the pressure for payment.
Any discussion with the original creditor at this point will weaken that pressure.
